The Blue Brook provides a digital storefront for greeting cards and a Design Studio tool for personalized message and layout configuration. Users may instantly and globally send cards to any recipient with a valid email address. Card contents may be updated or modified at the discretion of the participating artists and The Blue Brook team to ensure compliance with Creator terms, privacy regulations, copyright laws, and our service standards and values.
The service is available to users aged 16 years or older. Users agree to use the service lawfully and uphold standards of decency and respect in all interactions.
The Blue Brook may change, suspend or close the Site, or any related integration or component software, part or feature of the Site, or restrict access to parts or the whole of the Site, without notice or liability.
Subscriptions are offered on monthly and annual plans with auto-renewal enabled by default, which users may manage through their profiles. Payment for Credit Packs, Cards, and Subscriptions is due immediately upon order and is non-refundable once the 'Send' action for a digital card is initiated. Card sending transactions cannot be undone or canceled except on a best-effort basis by contacting customer support at support.thebluebrook.com. Billing disputes or service issues must be reported via the support portal.
Failed payments will be retried according to Stripe's standard retry schedule. Accounts with outstanding balances may be suspended until payment is resolved. All fees are displayed in the user's local currency where supported, and taxes may apply based on jurisdiction.
Where a user purchases a Subscription it does not commit The Blue Brook to the future maintenance or availability of the Site or its related services and features.
All card content and Creator contributions are subject to moderation and may be declined or removed at The Blue Brook's sole discretion. Prohibited content includes but is not limited to: hate speech, threats, harassment, explicit sexual content, illegal activities, copyright infringement, and spam.
Users must refrain from using threatening, abusive, hateful, or otherwise inappropriate language in personalized card messages. Users found to have violated content guidelines may appeal moderation decisions by contacting support. Material breach of these rules or abusive behavior may lead to immediate account suspension or termination without refund. Scheduled card deliveries may be canceled or deleted under such circumstances.
All software, platform content, and related intellectual property are proprietary to Ankh G.K / Ankh LLC, Japan. Creators are granted a limited license to host their materials for sale on the platform. Users are granted a license solely for card creation, scheduling, and distribution purposes. All other rights are reserved.
Cards, images, avatars, biographies, videos, and other user-generated content remain the property of the Creator and/or The Blue Brook and its affiliate Ankh, governed by specific Creator agreements. By using the service, users grant The Blue Brook a worldwide, royalty-free license to use, display, and distribute their personalized messages and customizations solely for the purpose of delivering cards to recipients.
Users do not acquire any ownership rights in platform content or Creator materials. The customization of cards via Design Studio does not confer ownership or create derivative works; all such content remains the intellectual property of The Blue Brook and its affiliates.
Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display, or in any way exploit, any of the Materials in whole or in part.
Specifically, users are not permitted to publish User Content, including Creator materials to social media, sharing networks or other electronic platforms which would constitute distribution of the materials to unlicensed parties.
No portion of the software or User Content is to be displayed within another web site or similar digital platform without express written consent from Ankh G.K. / Ankh LLC, Japan and its affiliates.
You agree not to use the Software in any manner that violates, plagiarizes, or infringes the intellectual property rights, privacy rights, or other personal or proprietary rights of any third party, including but not limited to copyrights and trademarks. You further agree not to upload, transmit, distribute, or otherwise make available through the Software any User Content that is defamatory, libelous, obscene, abusive, or otherwise illegal.
You must not use the Software to send or distribute User Content to any recipient with the purpose or effect of harassing, threatening, or causing distress to that person.
If any claim, demand, or legal action is brought against the Company as a result of your violation of these Terms, you agree to provide reasonable cooperation in the defense of such claim. Notwithstanding the foregoing, the Company may, at its sole discretion and expense, assume exclusive control over the defense and settlement of any such matter.
You are prohibited from using the Software to distribute User Content to mailing lists, or to send unsolicited bulk messages or commercial communications (spam). Any use of automated scripts, bots, or other programs to automate the uploading, transmission, viewing, or interaction with User Content or the Software is strictly forbidden.
The Company may, in its sole discretion and without prior notice, impose limits on the volume of User Content you may upload or transmit, the number of transmissions you may make, or the number of recipients to whom you may send User Content through the Software.
The Blue Brook and its affiliates are not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the service.
To the fullest extent permitted by applicable law, The Blue Brook provides the Software "as is" and excludes all representations, warranties, conditions, and other terms (whether express or implied) that might otherwise apply to the Software or any User Content.
Users agree to use the platform at their own risk. Specific legal disclaimers required by relevant jurisdictions may apply.
If The Blue Brook fails to comply with these Terms, it shall be responsible only for loss or damage you suffer that is a foreseeable result of The Blue Brook's breach of these Terms or its negligence, but not otherwise. Loss or damage is foreseeable if it is an obvious consequence of the breach or negligence, or if it was contemplated by you and the Company at the time you accepted these Terms.
In no event shall the Company's total liability to you for any such loss or damage exceed the total amount of fees (if any) paid by you to the Company for access to or use of the Software during the twelve (12) months preceding the event giving rise to the claim.
The Software is provided solely for your personal, non-commercial use. You agree not to use the Software for any commercial, business, or resale purposes. The Blue Brook shall have no liability to you for any loss of profit, loss of business, loss of revenue, business interruption, loss of business opportunity, or any indirect, consequential, or special damages, however arising.
The Blue Brook shall not be liable for any loss or damage caused by viruses, distributed denial-of-service attacks, or other technologically harmful material that may infect your computer equipment, software, data, or other property as a result of your use of the Software, your transmission or receipt of any User Content, or your access to any third-party websites or resources linked through the Software.
Users may terminate accounts by canceling subscriptions via their profile. Purchased services including subscriptions, credit packs, or cards are non-refundable upon cancellation. The Blue Brook and Ankh reserve the right to suspend or terminate user accounts that violate these terms or applicable laws, without refund.
Data handling is governed by our Privacy Policy, which users agree to by using the service. For details, please refer to our Privacy Policy.
The Blue Brook may update these Terms periodically. Changes will be published on this page with clear identification. Notification may also be sent via email or upon next service use. Continued service use indicates acceptance of updated terms.
Digital cards are delivered via email to the recipient's provided email address. The Blue Brook is not responsible for email delivery failures due to invalid email addresses, full inboxes, spam filters, or recipient email service issues. Cards are typically delivered within minutes of sending, but delivery times may vary based on email service providers.
Scheduled cards will be delivered at the specified time in the sender's time zone. Digital cards remain accessible to recipients for a minimum of 30 days from delivery date. The Blue Brook reserves the right to remove expired cards from our systems.
These Terms are governed by the laws of Japan. Any disputes arising from these Terms or service use shall be resolved through binding arbitration in Tokyo, Japan. Users waive their right to participate in class action lawsuits. The arbitration shall be conducted in English unless otherwise agreed.
The Blue Brook strives for 99.9% uptime but does not guarantee uninterrupted service availability. Scheduled maintenance windows will be announced 24 hours in advance via email and platform notifications. Emergency maintenance may occur without prior notice when necessary for security or service stability.
Users may request a copy of their personal data by contacting support. Data will be provided in a commonly used, machine-readable format within 30 days of the request. The Blue Brook will retain user data for the periods specified in our Privacy Policy, after which it may be permanently deleted.
The Blue Brook may offer beta features or services for testing purposes. These features may be modified, discontinued, or made available for general use at our discretion. Beta features are provided 'as is' without warranty and may contain bugs or incomplete functionality.
Payment processing is conducted through Stripe. Platform hosting, security, and infrastructure are provided by AWS. Users acknowledge and consent to interactions with these third parties as part of service delivery.
